TERMS AND CONDITIONS FOR THE USE OF THE MOBILE APP

These terms and conditions (hereinafter, the “Terms and Conditions”) govern the relationship between you (hereinafter “User”) and the Pan American Health Organization, Regional Office for the Americas of the World Health Organization (hereinafter, “PAHO/WHO”) for this mobile application (hereinafter, the “App”), both for its web version and for the mobile phone version that can be downloaded from the official application stores.

By downloading or using the App, you agree to the following Terms and Conditions. In the case of any discrepancy between the Spanish and English texts of these Terms and Conditions, the Spanish version shall prevail.

PAHO/WHO, reserves the right to institute legal action to stop any infringement or breach of these Terms and Conditions.

PAHO/WHO may, at its sole discretion, modify these Terms and Conditions. Using the PAHO/WHO App after such modifications take effect constitutes acceptance by the User of the new Terms and Conditions.

PAHO/WHO reserves the exclusive right to cancel any User’s access to the App as a result of a breach of these Terms and Conditions, at its sole discretion.

The information that you may provide to PAHO/WHO is governed by PAHO/WHO’s Privacy Policy available at www.paho.org.

The App Does Not Provide Medical Advice

 

The contents of the App, including, but not limited to, text, graphics, images, and other materials created by PAHO/WHO, or obtained from PAHO/WHO's licensors, and other materials contained in the PAHO/WHO App (collectively, “Content”) are for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment and does not constitute medical or other professional advice.  PAHO does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the App.  Reliance on any information provided herein is solely at your own risk.

 

Use of the Content and Submissions

 

The Content posted on the App is protected by copyright laws. PAHO/WHO authorizes you to view or download copies of the Content solely for your personal, noncommercial use. This work is available under the Creative Commons Attribution-NonCommercial-ShareAlike 3.0 IGO licence (CC BY-NC-SA 3.0 IGO; https://creativecommons.org/licenses/by-nc-sa/3.0/igo).

 

Title to the Content remains with PAHO/WHO or its licensors. Any use of the Content not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. Content and other features are subject to change or termination without notice at PAHO’s discretion. All rights not expressly granted herein are reserved to PAHO/WHO and its licensors.

 

If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

 

By uploading any content or material through the App, such as a picture or a video, you (a) (a) grant PAHO/WHO a perpetual, irrevocable, non-exclusive, royalty-free, sublicensable right to use, copy, print, publicly display, reproduce, modify, publish, transmit, create derivative works, and distribute such content or material; (b) you certify that you have obtained the consent of anyone appearing in such content or material (or, if you are a minor, your parent/legal guardian has obtained such consent) for PAHO/WHO to use, copy, print, publicly display, reproduce, modify, publish, post, transmit, create derivative works from, and distribute the media and any materials contained in the content or material; and (c) you agree to indemnify PAHO/WHO’s officers and employees and hold them harmless from any claims and/or expenses, including attorneys’ fees, arising out of your use of and/or your breach of these Terms and Conditions.

 

PAHO/WHO reserves the right to review all content and/or material before uploading/incorporating them into the App and reserves the right to remove any content and/or material for any reason, at any time, without prior notice, at its sole discretion.

 

Use of PAHO/WHO’s Name

 

PAHO/WHO’s name, acronym, and/or logo, as well as its branding, are protected by international law. Except for purposes of attributing authorship, they may not be used without PAHO/WHO’s prior express and written authorization. PAHO/WHO’s name, acronym, logo and/or branding may not be used for promotional purposes or in any form that indicates, suggests, or could be interpreted as representing association or affiliation with PAHO/ WHO, or the Organization’s sponsorship or backing.

 

Limitation of Liability

The use of the PAHO/WHO App and the Content is at your own risk. The data, information, and documents published on this App or sent through it are provided without any type of explicit or implicit guarantee. PAHO/WHO do not offer guarantees, nor is responsible for the accuracy or truth of the information or documents provided herein. PAHO/WHO may periodically modify or discontinue any document that it makes available to the public through this App, with or without prior notice. Under no circumstance will PAHO/WHO be liable for losses, damages and/or harm that may allegedly be derived from the use of this App or its information, data, or documents. Users must utilize this App at their own expense and risk. In no case will PAHO/WHO be liable for losses and/or harm even when prior notice could have been given concerning them.

The use of country or territorial designations must not be regarded as indicative of PAHO/WHO’s position regarding the legal status of any country or territory, its authorities and institutions, or the recognition of any border.

 

PAHO/WHO will not be liable for any damages or loss that may derive from or be related to the use of or flaws in the App or the information contained herein, including in cases arising from inappropriate, improper, or fraudulent use. Nor will it be responsible for the accuracy, availability, or truth of the information contained herein.

PAHO/WHO does not offer guarantees of any kind concerning the information available on the App and will not be responsible for any computer-virus infection or any other program that may affect the functioning of computers or systems.

Some of the documents that the User can access through this App may belong to third parties; PAHO/WHO does not guarantee ownership and will not be responsible to the User or third parties for any claim deriving from their use. It is possible that the App or the documents may contain links to external sites not managed by PAHO/WHO. Such links are included for reference purposes and their inclusion does not imply PAHO/WHO’s approval or endorsement. PAHO/WHO does not assume responsibility for the information contained on such external sites.

Use of this App implies the User’s acceptance of the obligation to defend and indemnify PAHO/WHO and its affiliates for any action, claim of damages, loss and/or expenditure (including attorney fees) that may derive from such use.

Privileges and Immunities

 

Nothing set forth herein shall constitute, or may be interpreted as a waiver, express or implied, of the privileges, immunities, and exemptions that PAHO/WHO enjoys in conformity with International Law, treaties or international agreements, or the legislation of its Member States.

Complaints for Possible Infractions

PAHO/WHO will make an effort to prevent activities on its App that are unlawful and contrary to the Terms and Conditions contained herein. Nevertheless, if you believe that an item of information contained on the App or among its materials may be contravening your rights or those of third parties, including, without limitation, intellectual property rights, you must contact PAHO/WHO, sending a detailed description of the alleged violation to the following address: hqleg@paho.org

Resolution of Disputes

Any dispute, controversy, or complaint that may arise or be derived from the use of the App or its information shall be resolved in an amicable manner between PAHO/WHO and the User. Unless the disputes or controversies are resolved in an amicable manner within sixty (60) days after one of the parties receives the other’s request to attempt to reach an amicable resolution, such dispute, controversy, or claim will be sent by either of the parties to arbitration in accordance with the Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL) in effect. The arbitral tribunal will not be authorized to impose punitive damages. Any arbitral award made in virtue of the aforementioned arbitration will be considered the final decision on the dispute, controversy, or claim, and will be binding on the parties.

If you do not agree with any of the terms and conditions contained herein, you must not use this App.

It was created in 1970 in Montevideo and currently is part of the Family, Health Promotion and Life Course (FPL) Department.
